This consultation seeks views on draft guidance on cross-border placements/dispute resolution and business failure. It also invites Welsh bodies to comment on the draft regulations on dispute resolution and business failure.
The UK Government’s Care Act sets out principles on cross border placements- when an adult’s need for care and support is best met with care in a different part of the UK. It also imposes duties on local authorities to meet care and support needs where registered providers of care suffer business failure.
Guidance has been drafted as well as regulations governing disputes between local authorities in relation to cross-border placements or business failure. These regulations will require the consent of the Welsh Ministers as they relate to Wales.
